TCR SMS Requirements and 3rd Party Payment Processing Web Form


We are a Non-Profit. We obtain donations through our 3rd-party payment processor's configurable forms on our website. Phone and Mobile Phone are among the available fields. Is it necessary that our processer's form "State that recipients are consenting to receive SMS messages...?"

Yes, in order for the recipient to be able to provide consent, they must know what they are consenting to. Simply asking for a phone number could imply that it is required to process the payment, or that you may call them. As such, in order to send SMS, the carriers want you to specifically state that "by submitting this form you are agreeing to be contacted by us including through SMS" or some language to that affect ("We will send a copy of your receipt via email and SMS upon completion of your donation").
